
HAVERSTRAW, N.Y. — The Village and Town of Haverstraw have taken legal action against Green Hills Adult Care and Assisted Living Facility, filing a lawsuit in Rockland County Supreme Court. The suit alleges gross negligence and failure to supervise residents, significantly harming the community.
Officials claim Green Hills has allowed its residents to roam unsupervised, leading to ongoing disruptions in the surrounding area. According to police records, more than 600 calls have been made since 2022 related to incidents involving Green Hills residents, including loitering, panhandling, public intoxication, drug use, and disorderly conduct.
Local Leaders Speak Out
“The Village has been saddled for years with being the recreational outlet for these residents, most of whom have mental health issues,” said Village of Haverstraw Mayor Mike Kohut. “They endanger themselves and motorists navigating Route 9W and crossing active railroad tracks to reach downtown. They panhandle, rummage through garbage, urinate and defecate in public, and wander the streets like zombies. Green Hills provides no supervision unless someone gets hurt, killed, or arrested.”
Defendants Named in the Lawsuit
The lawsuit targets four defendants:
- Haverstraw PropCo LLC (owner of the property)
- Green Hills LLC
- Hudson Senior Day Care LLC
- Magnolia Home Care Services LLC
Haverstraw PropCo LLC, a Brooklyn-based entity of The W Group, purchased the facility for $12.25 million in April 2023. The W Group operates more than 20 adult care and assisted living facilities across New York and partners with the referral service A Place For Mom.

State Violations and Lax Supervision
Green Hills, licensed for 164 residents with 51 Assisted Living Program beds, claims to provide expert medical care and 24-hour supervision. However, state inspections tell a different story. The New York State Department of Health (DOH) cited 40 violations from October 2020 through September 2024, including resident monitoring, food service, personnel, environmental conditions, and case management failures.
The most recent DOH inspection in July 2024 highlighted Green Hills’ failure to monitor residents for behavioral changes, failure to arrange appropriate medical evaluations, and lack of proper case management.
Pattern of Negligence by The W Group
The W Group has faced scrutiny at multiple facilities. Bronxwood Assisted Living and Riverdale Home for Adults in the Bronx have been investigated for poor management, while Broadview Manor in Staten Island has a long history of violations.
Legal Action and Community Impact
The lawsuit seeks:
- A declaratory judgment that Green Hills’ lack of supervision is unlawful.
- A court-ordered injunction requiring the facility to supervise and monitor residents properly.
- Economic, exemplary, and punitive damages for alleged willful and reckless neglect.
The complaint documents a disturbing history of incidents, including a resident found sleeping in a Main Street hallway, another reported missing before being discovered trespassing in an alleyway, and false police reports involving hallucinations. More recent reports cite residents exposing themselves in public, urinating at a gas station, and obstructing traffic.
Failure to Fulfill Legal Obligations
Under New York law, operators of Adult Care Facilities must provide 24-hour supervision and ensure residents’ general whereabouts. Assisted Living Programs (ALP) serve individuals eligible for nursing home care but in a lower-cost setting, requiring personal care, medical oversight, and emergency response services.
The lawsuit contends that Green Hills has failed in its state-mandated duties, leaving the community to bear the consequences.
Requests for comment from The W Group and the State Long-Term Care Ombudsman’s Office went unanswered.
This case highlights broader concerns over oversight and accountability in New York’s assisted living industry. With mounting evidence of negligence, Haverstraw officials are demanding action to protect residents and the wider community.
